Abstract:
With China’s economic expansion and the capitalization of the economy, competition among companies became harsher and harsher, the market is more and more complicated, and the companies are not state-owned anymore. So, if business doesn’t go as planned, it is necessary to ask for lendings. These lendings can be issued both by banks or by other companies, but this can often lead to many problems.
Bank of China borrowed a significant amount of money to Jiangsu Haiwai Qiye Jituan Youxian Gongsi, which wasn’t returned, so the Bank took Jiangsu Haiwai Qiye Jituan Youxian Gongsi to the court. However, Bank of China lost the first instance, so went to the court again filing an appeal. The court of appeal analyzed the case and issued a new sentence, which also took Jiangsu Haiwai Qiye Jituan Youxian Gongsi’s side.
The text also contains the names of many organs and codes typical of the Chinese legislative and judicial system, of which a translation will be proposed.
This dissertation contains a translation into Italian of the court sentence, along with its analysis and some explanations of the research work that was made during the process of translation, especially for some specific terms. These terms will be analyzed and the process that brought to their translation will be made clear, with the help of many academic articles and corpora. It also contains a brief analysis of both Italian and Chinese judicial systems and contract laws, highlighting the differences and the similarities between them.
